Terms of service

These Terms incorporate the Privacy Policy, Intellectual Property Policy, and, when Recustom processes personal data for a merchant, the Data Processing and GDPR Terms. A written order form or enterprise agreement may add service-specific terms. If it conflicts with these Terms, the signed agreement controls for that conflict.

You must provide accurate information, keep it current, protect credentials and API keys, and promptly notify us of suspected unauthorized access. You are responsible for actions taken through your account, including actions by employees, contractors, and connected applications that you authorize.

Recustom may require verification, restrict permissions, rotate credentials, or suspend access when reasonably necessary to protect the Service, comply with law, address fraud, or investigate a violation of these Terms.

Recustom helps merchants develop personalized products, create listings and marketing assets, prepare customer-specific production files, connect commerce channels, route orders to production partners, and synchronize fulfillment status. Features, channel availability, suppliers, models, and processing methods may change as the Service develops.

Recustom is a technology and workflow provider. Unless a signed agreement says otherwise, the merchant remains the seller or merchant of record and is responsible for its storefront, product claims, pricing, taxes, customer service, refunds, and compliance with the rules of each connected sales channel.

When you connect Shopify or another service, you authorize Recustom to access and use the data and permissions needed to provide the requested integration. Your use of a third-party service remains subject to that provider's terms. Recustom is not responsible for a third party's availability, policies, API changes, account decisions, or independent acts.

You must review imported products, orders, customer details, and fulfillment settings. You are responsible for ensuring that each connected store and order is authorized and that the permissions granted to Recustom are appropriate for your business.

AI-generated or AI-assisted text, images, recommendations, classifications, and production assets can be incomplete, inaccurate, or similar to material generated for others. You must review outputs before publishing, manufacturing, advertising, or relying on them. Recustom does not guarantee that an output is unique, error-free, non-infringing, or suitable for a particular commercial purpose.

You authorize Recustom to process your inputs through selected models and infrastructure to deliver the requested feature. You must not use AI features to create unlawful, deceptive, abusive, infringing, or unsafe content, or to make decisions that require professional legal, medical, financial, or other regulated advice.

You retain rights you hold in content submitted to the Service. You grant Recustom and its service and production partners a worldwide, non-exclusive, limited license to host, copy, transform, transmit, display, and use that content only as needed to operate, secure, support, and improve the Service and to manufacture and fulfill your authorized orders.

You represent that you have all rights, consents, notices, and lawful bases needed for the content and personal data you submit, including customer photographs, names, likenesses, trademarks, artwork, and delivery information. Our Intellectual Property Policy explains these responsibilities and the complaint process.

Product descriptions, previews, delivery estimates, and production availability are estimates. Personalized manufacturing can produce reasonable differences in color, placement, dimensions, finish, materials, and appearance. You are responsible for checking the product specification and production asset before approval when an approval step is offered.

Production may be performed by independent partners. Once production has started, cancellation or modification may not be possible. Shipping estimates are not guarantees. Customs, carrier events, incorrect addresses, restricted destinations, and events outside reasonable control may affect delivery.

Because personalized goods are made for a specific order, changes of mind and customer design choices are generally not refundable after production starts. If a product arrives damaged, materially defective, or materially different from the approved specification, report it promptly with the order number and clear evidence. Recustom will assess the claim under the applicable production partner and channel rules and may arrange a reprint, credit, or refund where appropriate.

A chargeback does not cancel outstanding obligations. You must first give Recustom a reasonable opportunity to investigate a billing or fulfillment issue through hello@recustom.ai.

You must not use the Service to:

Recustom and its licensors own the Service, software, Product Skill frameworks, templates, interfaces, documentation, branding, and related intellectual property, excluding your content. Subject to these Terms, Recustom grants you a limited, non-exclusive, non-transferable, revocable right to use the Service for your internal business and authorized commerce operations.

Feedback may be used without restriction or payment, provided Recustom does not identify you publicly as its source without permission.

We may update, replace, limit, or discontinue features, models, integrations, suppliers, or plans. We aim to give reasonable notice when a change materially reduces a paid feature, unless an urgent security, legal, provider, or platform issue requires faster action. The Service may be interrupted for maintenance, incidents, or events outside our reasonable control.

You may stop using the Service and cancel an eligible subscription through the available account or billing controls. Recustom may suspend or terminate access for material breach, nonpayment, fraud, security risk, legal requirement, platform action, or harm to Recustom, its partners, merchants, or customers.

On termination, your right to use the Service ends. Payment obligations, licenses needed to complete accepted orders, intellectual property provisions, disclaimers, liability limits, dispute provisions, and terms that by their nature should survive will remain effective.

To the maximum extent permitted by law, the Service is provided "as is" and "as available". Recustom disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Recustom does not warrant uninterrupted operation, specific commercial results, perfect AI output, exact preview-to-product matching, or the acts of third-party platforms, production partners, or carriers.

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenue, goodwill, business opportunity, or data, even if advised that such loss was possible.

Recustom's total liability arising from the Service will not exceed the fees paid by you to Recustom for the Service during the 12 months before the event giving rise to the claim. These limits do not apply where liability cannot legally be limited, or to a party's fraud, willful misconduct, or violation of the other party's intellectual property rights.

To the extent permitted by law, you will defend and indemnify Recustom and its affiliates, personnel, and service and production partners from third-party claims, losses, and reasonable costs arising from your content, products, storefront, customer relationship, breach of these Terms, or violation of law or another person's rights. Recustom will provide prompt notice and reasonable cooperation, and you may not settle a claim in a way that admits fault by or imposes obligations on Recustom without written consent.

Before filing a formal claim, contact hello@recustom.ai and give both parties 30 days to try to resolve the dispute informally. Unless a signed agreement specifies otherwise, these Terms are governed by the laws of the jurisdiction in which Vitamin Creative Lab Limited is incorporated, without regard to conflict-of-law rules, and the courts of that jurisdiction will have exclusive authority over disputes.

Nothing in this section removes rights or remedies that cannot be waived under applicable law.

We may update these Terms. The current version will be posted here with a revised date. We will provide additional notice where a material change requires it. Continued use after the effective date of an update means you accept the updated Terms.
