Intellectual property policy

Rules for merchant content, customer photographs, AI-assisted assets, product listings, infringement notices, and Recustom technology.

Personalized commerce begins with content supplied by merchants and their customers. This policy explains the rights required to use that content with Recustom, how we respond to infringement reports, and which rights remain with Recustom.

This policy forms part of the Recustom Terms of Service. It applies to images, photographs, names, likenesses, logos, trademarks, artwork, text, prompts, product designs, listings, production files, and other material submitted to or used with the Service.

01Your content remains yours

As between you and Recustom, you retain the intellectual property rights you hold in your content. Using the Service does not transfer ownership of your content to Recustom.

You grant Recustom and the service, AI, production, and logistics partners involved in your workflow a worldwide, non-exclusive, limited license to host, copy, process, transform, transmit, display, and use your content only as needed to provide, secure, support, and improve the Service and to manufacture and fulfill authorized orders. This operational license continues only for as long as reasonably needed for those purposes, accepted orders, legal retention, and protected backup cycles.

02Rights and permissions you must have

For every item submitted to Recustom, you represent and warrant that:

  • you own it or have a valid license, authorization, or other legal right to use it for the intended product and sale;
  • you have permission from people depicted or identified in it, including any required consent from a parent or legal guardian;
  • your use does not infringe copyright, trademark, design, publicity, privacy, moral, contractual, or other rights;
  • you have provided any notice and obtained any consent required to send customer content and personal data to Recustom and its partners; and
  • your listing, advertising, and product claims are accurate and comply with the rules of each sales channel and destination market.
A file being available online, included in a template, or produced by an AI tool does not by itself give you the right to sell or reproduce it.

03Customer-submitted personalization

If a storefront customer uploads a photograph, name, message, or other personalization, the merchant is responsible for obtaining terms and permissions that allow the merchant, Recustom, and the relevant production partners to use that content to create and deliver the ordered product.

Merchants should provide a clear customer notice, limit uploads to content appropriate for the product, and maintain a process for complaints and removal requests. Recustom may require evidence of permission or decline an order that presents an infringement or safety risk.

04AI-assisted inputs and outputs

You remain responsible for selecting inputs, reviewing outputs, and deciding what is published or manufactured. AI output may not be unique and may resemble content available to others. Copyright and other protection for AI-generated material varies by jurisdiction and depends on the facts. Recustom does not guarantee that an output is protectable, exclusive, or free from third-party rights.

Do not ask the Service to imitate a living artist, copy a protected character, reproduce a brand, create a deceptive endorsement, or remove copyright or provenance information when you do not have authority to do so.

05Content we may reject or remove

Recustom may pause production, disable a listing, restrict an account, preserve evidence, or remove content when we reasonably believe action is necessary. We may notify the merchant and provide an opportunity to respond when appropriate.

  • counterfeit products or unauthorized use of brands, characters, celebrities, artwork, photographs, or designs;
  • content that infringes intellectual property, privacy, publicity, or contractual rights;
  • illegal, deceptive, defamatory, exploitative, hateful, or non-consensual content;
  • content that sexualizes or exploits a minor or depicts abuse;
  • content used to impersonate another person or falsely suggest sponsorship, affiliation, or endorsement; and
  • content prohibited by law, sanctions, a connected platform, a payment provider, or a production partner.

06Report alleged infringement

A rights owner or authorized representative may send a notice to hello@recustom.ai. The subject line should identify it as an intellectual property notice.

A complete notice should include:

  1. your full name, organization, postal address, email address, and phone number;
  2. the intellectual property right at issue and evidence that you own it or are authorized to act for the owner;
  3. a precise identification of the allegedly infringing material, including the Recustom, store, product, order, or listing URL when available;
  4. an explanation of why the use is not authorized by the owner, its agent, or law;
  5. a good-faith statement that the information in the notice is accurate;
  6. a statement, where legally required, made under penalty of perjury that you are the owner or authorized to act for the owner; and
  7. your physical or electronic signature.
Do not include unrelated customer personal data, account passwords, payment card details, or confidential evidence that is not needed to assess the claim.

07How we handle a notice

We may request more information, forward the notice and contact details to the affected merchant, disable access to content, pause an order, or take other proportionate action. We may reject notices that are incomplete, abusive, fraudulent, or outside our control.

Recustom does not decide private ownership disputes. Parties may need to resolve a dispute directly or through a court or other competent authority. We may comply with valid legal orders and preserve relevant records where required.

08Response or counter-notice

A merchant who believes content was restricted by mistake may respond with identification, the affected material, the basis for authorization or lawful use, supporting evidence, and the declarations required by applicable law. We may share the response with the complainant and restore content when legally appropriate, but production timelines cannot always be restored.

09Repeat or serious infringement

Recustom may suspend or terminate accounts associated with repeated infringement, a pattern of unsupported rights claims, counterfeit activity, fraudulent notices, or a serious single violation. We consider the nature, evidence, context, history, and applicable law before taking action.

10Recustom technology and branding

Recustom and its licensors own the Service, software, Product Skill frameworks, workflows, interfaces, templates, documentation, databases, branding, and related rights, excluding merchant content. Your account provides a limited right to use the Service under the Terms. It does not grant a right to copy, reverse engineer, resell, sublicense, scrape, or build a competing service from Recustom technology or protected content.

"Recustom", its logo, and related marks may not be used to imply endorsement, partnership, certification, or affiliation without written permission. Accurate references describing compatibility with Recustom may be permitted if they follow applicable brand guidance and do not create confusion.
